Marinwood CSD "Censorship by Procedure" May 10, 2016





May 10, 2016 Marinwood CSD Directors Jeff Naylor and Justin Kai justify their new speech policy that forces the public to speak on agenda items BEFORE they are discussed. Since the Marinwood CSD does not produce detailed reports in the board packet the public has no way of knowing what is to be discussed. Items in the agenda are usually vague descriptions meant to obscure the topic of discussion. For example, in January 2015, a new dog leash law was described as "changes in park policies."

The new Marinwood CSD board members are hostile to public participation in "their" meetings and have found ways to censor the public through procedure. We are not fooled.

  1. I believe that the Board Pres. is afraid to hear comments that are not 100% in agreement with his own views. IMO that is why there is additional censorship (against public comment) introduced this year. Previous Board Pres. have followed the Brown Act LAW, and allowed the public to participate DURING the legislative body's consideration of an agenda item.

    Without any information on a Board agenda item, other than a 5 - 10 word item description, the public must be mind readers, in order to speak BEFORE the Board discussion. How is it logical, to be able to "participate", if we have NO knowledge of what any of the 5 Board members are thinking or will be saying about an item?

    At the April 12, 2016 Board meeting, there was an agenda item "Approval of Draft Board Bylaws". There was NO MENTION that additional CHANGES to the Bylaws were going to be made. At the last minute, the Board Pres. slipped in a revision that will now allow him to respond to Social Media public comments on District matters (such as on Nextdoor) which he believes require corrections. This has NOT been the District policy for over two years, and NO public comment was allowed when he made the revision.

  2. You don't understand what censorship actually is and your interpretation of the Brown Act is poor at best. Your inflation of issues due to your ignorance is tiring and costly to tax payers. You should be invoiced for the amount of work effort you waste on these Quixotic crusades.

  3. So according to this anonymous know it all, no one should question the authority of the board. Apparently a civil discussion is not possible. Call the Sheriff! People are being disruptive!

  4. The biggest waste of Marinwood Csd resources, is not citizens asking for the law to be followed but the Marinwood Csd board seeking legal advice to avoid following the law. The above video is an example of the arrogance of the board that tries to avoid their duty to engage the public. The marinwood CSD board has wasted literally hundreds of thousands of dollars in feckless pursuits such a the SolEd solar deal that will cost the CSD at least double the cost of comptetitive systems. The citizens did the research and presented the board with facts that were ignored. The board president has wasted staff resources on personal issues and has called the police to intimidate the public, ballooned the payroll and has the audacity to suggest that the public should be quiet.

  5. Thanks Anonymous (Paul), you are absolutely brilliant. I have an idea WHERE/WHO you are getting your mis-information from. Perhaps you should start attending MCSD Board meetings and see for yourself what the 2016 Pres. is doing. You can also check out previous year's Board meetings on video, (on this website), and see how previous Board Pres. allowed public participation DURING the Board's consideration of an agenda item. It WAS as the LAW intended it to be.
