My letter to the RWQCB regarding Marinwood plaza

Dear Mr. Wolff:
As you know the Prosperity Cleaners (Case #21s0053) waste cleanup is finally underway after nearly ten year delay.
The neighbors of the Marinwood Plaza (Prosperity Cleaners) site are very anxious about the continuing delays, lack of oversight by the RWQCB and misinformation given to the RWQCB and public concerning cleanup.
We respectfully request on sight inspections by the RWQCB to ensure that the RAP is performed in accordance to the agreement and is not modified for convenience and/or cost.
The February 1, 2017 deadline for compliance established by the RAP and Addendum 2 has been missed and should be subject to immediate financial penalties.
1.) The discharger delayed clean up for months and now has modified the original plan to suit their needs. The discharger waited until late September to start search for company to do the work , then claimed that they could not find a company for asbestos abatement for months and suddenly at the 11th hour, the discharger unilaterally decided not to demolish the building. Now, they need additional time to shore up the building due to danger of roof collapsing due to the excavation, to resume excavation. But the building should be demolished to allow the removal of soil at the hotspot underneath the exterior wall.
Why does the RWQCB allow the discharger to change the terms of the RAP especially when it means that the toxic waste will remain untreated?
2.) The original RAP calls for the removal of a section of soil 25" x 25" x 15' (347 cubic yards of soil). On the morning of the first day of excavation, the Clean up Marinwood Plaza Now oversight committee learned from field workers/company that the planned excavation was ONLY 8 FEET depth and that all soil removal would stop when reaching water. Days later water was detected at 7 FEET.
When Geologica was confronted with the discrepancy with the field orders, they told the committee that there was a "misunderstanding" by the field workers and told us that they would "correct the error".
Later that day, field workers were told not to speak with the public and Geologica erected barriers and posted signs to keep the public away. I managed to photograph through an open door and shortly thereafter a large barrier was erected to keep me from photographing the interior.
Since the RWQCB manager is not Haz Mat certified, he has not entered the site and is not in a position to certify the quality of the work and the accuracy of the data provided by Geologica. Likewise, the public has been completely barred from even monitoring it from a sale distance while many workers and delivery people were observed free entry to the site without safety gear or presumably 40 hours of Haz Mat training.
It appears that the discharger is intentionally keeping its cleanup activities hidden while expecting a certification from the RWQCB.
3.) The project property manager Mr. Fitzsimmons seems to be reporting false information to the RWQCB about the work status. For example on January 31, 2017, Mr Fitzsimmons reported that work to shore up the building had begun and excavation would continue today and be wrapped up in a couple of days. No such work has been performed. The excavator and Bobcat were removed on January 31, 2017 by the rental company and the site closed up. One of the committee members notified your staff of what was happening of which they were unaware. Your staff contacted Geologica and they advised that the site was shut down due to the contractor personnel attending a training session and the excavator and Bobcat to return Thursday night with excavation to resume on Friday. No mention of the shoring up of the roof prior to continuing the work.
4.) The current toxic waste soil in the containment area is far less than 347 cubic meters. By estimating the volume it appears that it is less than halfway complete. The public seeks FULL remediation as outlined in the RAP. We ask that the RWQCB fulfill its duty to protect the water and environmental health of our community by requiring
a.) Institute financial penalties for further non compliance and false status reporting
b.) Haz Mat certified staff to field verify that all terms of the RAP are fulfilled and progress monitored throughout the remaining remediation .
c.) Immediately determine the need to demolish the building for full clean up and force the discharger to comply with the original RAP.

Vincent's), Rob Graham and I (Cleanup Marinwood Plaza Now Oversight Committee)
just returned from the RWQCB meeting in Oakland today. First, I delivered a
letter from Supv. Connolly to the directors. An update for you on what is
happening at the Plaza.
First, the District Staff is reviewing the comments on the cleanup on Siveira Ranch and St. Vincent's and staff will be presenting to the directors at the February 8, 2017 RWQCB meeting..
Second, and most important to us as Marinwood Community, is that the cleanup of the cleaners has started this week. That being removal of lead and asbestos. It should be noted that Hoytt is not going to be demolishing the Plaza sans the market, but doing the cleanup of only the cleaners without demolition--other words-less expensively. The contractor has placed an enclosed conex box at the big door behind the cleaners and he has sealed off the opening all around it to avoid atmospheric exposure. Tentatively, this will be accomplished by 1/16/2017 to allow the digging and removal of the contamination under the cleaners. Per staff at the RWQCD, Hoytt will be removing the contaminated soil and concrete and piling in in back of the cleaners until a waste site gives permission to deliver the contaminated material. This waste pile will be tarped at night, exposed during the day, until such action takes place. Based on the winds and rain that we have experienced over the past week,. there is a strong possibility of the tarp coming off. If that occurs, we could have contaminated material being blown into the surrounding area, including the market, and the runoff going into the storm drains, and even Miller Creek.
In my opinion, this is not a great scenario for public health and safety. Hoytt has until February 1, 2017 to a completion report meeting the acceptable standards for cleanup submitted to the RWQCD. Cleanup Marinwood Plaza Now Oversight Committee, at the meeting today, voiced concerns that failure to comply in full with the executive order, that Hoyt be penalized per regulations since Hoytt has had since April 19, 2016 to comply with this date.
In addition, I brought up the Eastern Hot Spot behind the cleaners where the cleaning solvent was dumped, still no plans to clean that up and the monitoring well reading is 34 ug/l which is 7 times acceptable level for drinking water. RWQCD staff said that the soil met the standard, but the reading in the ground water wasn't a concern. In addition, Rob Graham spoke to the contaminated waste pile. The Oversight Committee will be attending the February 8, 2017 RWQCB meeting along with representatives from Silveira Ranch and St. Vincent's.
I anticipate that Supv. Connolly will also be in attendance. We would appreciate additional members of the community attending with us. The more the more effective is our concerns. I will be providing additional information on the meeting time. I will continue to post updates on what is happening at the Plaza.

Marinwood Residents Demand the immediate cleanup of the Toxic Waste at Marinwood Plaza (9 min)
Marinwood Residents demand the immediate clean up of the Toxic Waste Hotspot at the former Prosperity Cleaners at the California Regional Water Quality Control Board in Oakland, CA on March 8, 2016. The former Prosperity Cleaners is located in Marinwood Plaza at 187 Marinwood Ave in San Rafael, CA . No active clean up has occurred since 2011 when the discharger, Marinwood Plaza LLC was allowed to suspend clean up while it was trying to sell the property. In the mean time, the toxic plume has spread 1/2 mile to the East and is not even fully defined. Toxic soil vapors threaten neighboring residents. Marinwood Plaza submitted an incomplete clean up plan to the board on December 28, 2015 . Residents demand immediate removal of the source contamination while plans for full remediation are created.

Marinwood, CA: Two members of the Clean Up Marinwood Plaza Now! citizen oversight committee, Bill McNicholas and Ray Day of Marinwood, bring a thick file of letters, petitions and scientific data to challenge the Remediation Action Plan for Marinwood Plaza. The plan submitted by Geologica on December 29, 2015 fails to fully identify the extent of the toxic plume, lacks scientific rigor, has testing inadequacies and relies on a scientifically inappropriate means to clean up the site called Monitored Natural Attenuation. Over 100 people signed the petition over the weekend to ask the Regional Water Quality Control Board to immediately remove the toxic hotspots on the site while a new plan is created and further testing and remediation of the plume continues. All active remediation was halted in 2011 when it was thought that a new buyer would assumption the liability for the cleanup. The property remains in limbo due to the costly and unknown nature of the cleanup. Once the site is cleaned up development can commence.
Marinwood Plaza is the only commercial viable location for a grocery store and other retail due to its convenient access to Highway 101. It is our town center. This site also has other toxic issues with MTBE and Benzene and is home to a high powered microwave antenna farm making the site unsuited to residential structures. The community welcomes affordable housing in the style of Rotary Village in Lucas Valley and encourages developers to submit projects that are sensitive to land use and healthy for families.

Dear Directors of the Regional Water
Quality Control Board & Mr Lambert:
We are depending on
you to do the right thing for our community and the environment.
I urge the Regional
Water Quality Control Board(RWQCB) to reject
in entirety the Remedial Action Plan (RAP) put forth by Marinwood
Plaza II , LLC and Geologica for Prosperity Cleaners, 187 Marinwood Ave,
San Rafael, CA 94903 (#SL0604185908) on December 29, 2015. The
Remedial Investigation is incomplete, the proposed action plan is
technically and scientifically inadequate and the plan does not meet EPA’s own CERCLA
guideline or meet the terms of the RWQCB Executive order of February 14,
2015. The action plan has no start date and is only contingent up on redevelopment.
This is clearly not consistent with the terms or intent
of the Executive Order. The RAP should be rejected until it complies with the Order and
describes complete remediation of the Site to include Marinwood Plaza, Silviera
Ranch, Casa Marinwood.and the eastern & western boundaries of Marinwood
Ave.
We strongly urge
an Interim Remediation Plan to commence at the earliest possible date
or by April 1, 2016 to aggressively remove the two or more toxic hotspots on
the site to a depth of 35’ and a diameter that encompasses all known
contaminated soil of at least 75’ or more.
No active remediation has occurred
since 2011. We demand full, aggressive remediation of the toxic hotspots at the Marinwood Plaza site immediately while
methods for remediating offsite contamination, whether soil vapor or
groundwater, are identified for timely implementation in an approved RAP. Partial solutions are unacceptable.
We concerned citizens of Marin
demand a full remediation of Marinwood Plaza (#SL0604185908)
that will not imperial the environment and community health for decades
to come.
Please
respond to the following questions:
Soil:
1.
Previously
it’s been disclosed that contamination at the source areas extends to a depth
of at least 35 feet. The RAP proposes
excavating soil to a depth of only 12 feet beneath the building and leaving the
remaining contamination in place.
What
happens to the deeper contamination that you propose to leave? Won’t that continue to contaminate
groundwater, as it’s doing now, and as noted in the Board Order?
2.
Soil
was sampled at only a few locations at the Eastern Hot Spot to verify soil
contamination after treatment in 2011.
Why are you not proposing to excavate in this area to verify that soil
contamination above cleanup standards is not present?
3.
The
RAP estimates that approximately 45 cubic yards of soil will be excavated based on very limited information. What will happen if the soil contamination
turns out to be much more extensive?
Soil Vapor:
1.
We
understand that contaminated soil vapor is moving preferential pathways along buried utility lines. When you tested for soil vapor in the Casa
Marinwood neighborhood you located the
underground utilities but avoided them during your testing. If you were concerned about damaging utility
lines as you claimed, why didn’t you use passive soil vapor sampling that has
commonly been used for investigations at other sites?
2.
Absolutely
no contaminated soil vapor was reported at Casa Marinwood, which is not
surprising because you did not sample the contaminant pathways where the vapor
is moving. When will you conduct a valid
soil vapor investigation at Casa Marinwood?
3.
Once
you’ve blocked the pathways for soil vapor at the Site, where will the
contaminated soil vapor that is present adjacent to Casa Marinwood go; into the
houses?
Groundwater:
1.
Why
did you submit a feasibility study that does not follow EPA guidance as
required by the Board Order?
2.
Why
do you think it’s reasonable to develop a remedial action plan when you haven’t
yet completed the remedial investigation?
3.
Why
haven’t you installed any monitoring wells east of Hwy 101?
4.
Why
have you not conducted any groundwater monitoring east of Hwy 101?
5.
Why
was MNA the only remedial approach considered in the feasibility study?
6.
How
can NMA be seriously considered when the extent of groundwater contamination is unknown?
7.
How
can you possibly evaluate whether the groundwater plume is stable or shrinking
if you don’t know how far it goes?
8.
Given
that dry cleaning fluid (PCE) is present a considerable distance east of Hwy
101, what evidence exists that supports the complete breakdown of PCE to
non-toxic compounds?
9.
Why
were remedial approaches that are commonly used to cleanup VOC contamination in
groundwater at sites in Silicon Valley not evaluated in the feasibility study?
10. Why
do you think it’s OK to contaminate millions of gallons of valuable drinking
water and then walk away without cleaning it up?

No Justice For Flint Water Victims
Unlike private companies, they can't sue their government

This sounds like a lot, but the fact of the matter is that it is far less than what Flint's victims would have gotten if a corporation — rather than government — had been the culprit. That's because, unlike private companies, the government is shielded from liability lawsuits.

This would be an excellent argument for the wholesale privatization of public utilities, but, alas, privatization is a dirty word in the liberal lexicon.
After initially giving Michigan Governor Rick Snyder only $5 million in going away money to help Flint residents buy water filters and bottled water, President Obama finally acquiesced this week to pleas for more help and authorized another $80 million. Now he's also considering Snyder's request for extending Medicaid eligibility to all Flint children up to age 21 regardless of their income or insurance status.
Setting aside the Medicaid expansion, the $85 million in federal aid combined with the$28 million in state aid that Snyder has arranged, works out to on average $1,000 for each of Flint's 99,700 residents — or about $4,000 for a family of four.
But consider the horror they are confronting:
As has been widely reported, 6.4 percent of Flint's nearly 8,500 kids are now testing for dangerously high lead levels in their blood stream — up from 3.6 percent before the city switched them from Detroit water to toxic Flint River water. Many of these children have developed rashes and brittle bones and face the prospect of permanent brain damage, diminished IQ, and behavioral difficulties. But kids are not the only ones hurt. Around 85 people have been diagnosed with Legionnaire's disease — a particularly horrible form of pneumonia — compared to around six to 13 in a normal year. Ten of them have already died.
Even if Obama expands free Medicaid for all Flint children, the rest of the medical bills — deductibles and co-pays — for middle-income Flint families will be substantial. Nor is that their only financial exposure.
The lead poisoning occurred because Flint failed to treat water with phosphorous, something that corroded the coating inside city pipes and home plumbing, allowing lead to leach in. Though switching back to treated water has diminished the lead content for now, the danger of lead poisoning will always remain unless all the piping is refitted. But replacing city pipes will cost up to $1.5 billion. This would be difficult for even a financially healthy city, let alone one that can't even pay its existing bills and has unfunded pension liabilities of $1.1 billion.
What's more, each homeowner will face at least $4,000 to install a new water heater, plumbing system, and a new service line connection, as The Washington Post points out. And then of course there is the hit to Flint's already declining property values as the city further cements its reputation as an irremediable basket case.
It is an understatement to say that Flint residents are in for some very tough times. But compare the pittance that they will get to the compensation that General Motors and Toyota crash victims received.
GM had to pony up $35 million to NHTSA (National Highway Traffic and Safety Administration) and $900 million to the Justice Department in penalties for the faulty switch in its 2005 Cobalt that was linked to 125 deaths and 250 injuries. What's more, despite the totally deplorable liability shield or immunity from personal injury lawsuits the automaker received from the Obama administration as part of its 2009 bankruptcy restructuring, it still paid $625 million in compensation to the victims. And of course it recalled and fixed all the 2.6 million affected vehicles. All in all, it was down $1.5 billion.
But Toyota coughed up more than double that amount for its suddenly accelerating vehicles that resulted in 12 deaths and 31 accidents. It paid $1.2 billion in fines to Justice and $35 million to NHTSA and fixed all the vehicles, of course. In addition, it made an out-of-court settlement for an undisclosed amount that was likely more than what GM paid to each victim. But the real kicker is that, because it did not have GM's liability shield, it also paid $1.6 billion to all Toyota owners for the loss of the resale value of their cars.
Compare all of that to the $115 million or so that Flint victims will receive!
The main reason that they don't have a prayer of collecting much more is something called the doctrine of sovereign immunity. Under this doctrine, citizens are barred from suing their government for screw-ups that it has caused in the course of discharging a core function unless the government itself consents. Some very narrow exceptions exist but it is very difficult to make them stick.
Some activist lawyers in Michigan have come up with a creative constitutional argument to try and surmount the sovereign immunity hurdle. They have filed a class action lawsuit on the grounds that the government failed to provide Flint residents with equal protection under the 14th Amendment. But this rationale is a stretch that many plaintiffs' lawyers are having trouble buying. Indeed, Reuters reported that law firms representing Southern California residents in their own class-action lawsuits against the recent gas leak caused by Southern California Gas Co, owned by the non-governmental Sempra Energy, have so far declined to participate in the Flint lawsuit because they don't think this reasoning will work.
Scrapping or at least circumscribing sovereign immunity may be worth considering although that isn't a great answer because it will only expose taxpayers to liability for snafus they have not committed.
Privatizing water utilities so that they can be held accountable by strong regulators and courts might be a better solution, as Stephen Carter points out in Bloomberg View. The penalties that private companies would have to pay would be an automatic motivation to minimize Flint-style scandals, especially if they are slapping homeowners with a $150 a month bill as Flint authorities have been doing (talk about greed!). And when these companies do allow them to happen, it would be easier to hold them accountable.
But don't stand on one foot waiting for a privatization program to catch on because in liberal land privatization is anathema. Liberals consider clean, drinking water a "public good" that ought to be immune to privatization and the profit motive. The Washington Post's Dana Milbank, hilariously enough, even tweeted: "Flint isn't a failure of government at all levels. It's a failure of Gov. Snyder's private-sector theology." Never mind that the Flint water system is owned and operated by the government from top to bottom.
Flint ought to be a wakeup call for liberals to stop putting religious faith in government. Until they smell the (clean water) coffee, future victims of future Flints will suffer without relief.
